Article 2 – Purpose and Scope
These General Terms and Conditions of Sale (GTC) apply to all sales concluded on the Maison Orvane website between the seller and any consumer (hereinafter "the Customer"). The Customer declares to have read and accepted them before placing an order. The GTC applicable are those in force on the date of the order.
Article 3 – Products
The essential characteristics of each product (dimensions, materials, color, package contents) are presented on its product page. The photographs are as faithful as possible; however, slight variations in shade may exist depending on the screen used. Offers are valid while stocks last.
Article 4 – Prices
Prices are indicated in euros, all taxes included (VAT not applicable, Article 293 B of the General Tax Code). Delivery is currently free to all served countries. The applicable price is the one displayed at the time of order confirmation.
Article 5 – Order
The Customer selects their products, checks the contents of their cart, enters their contact details and delivery address, then confirms their order with an obligation to pay. The sale is concluded upon confirmation of payment. A confirmation email summarizing the order is sent to the Customer. The seller reserves the right to cancel any order in the event of an existing dispute with the Customer, product unavailability, or suspicion of fraud; the Customer is then fully refunded.
Article 6 – Payment
Payment is made online at the time of the order, by the payment methods offered on the payment page. Transactions are secured and encrypted by the payment provider; the seller never has access to the Customer's full bank details.
Article 7 – Delivery
Products are delivered to the address indicated by the Customer, in France and in the following countries: Germany, Belgium, Croatia, Spain, Hungary, Italy, Luxembourg, Netherlands, Poland, Portugal, Slovakia, Slovenia, and Czech Republic. The islands and certain isolated areas are not served. Details are available on the Delivery page.
Indicative delivery times from shipment: 3 to 5 days for France, 3 to 10 business days for the other served countries. Unless otherwise indicated, the product is delivered no later than 30 days after the conclusion of the contract. In the event of a delay, the Customer may, after instructing the seller to carry out the delivery within an additional reasonable period, terminate the contract under the conditions of Articles L216-6 et seq. of the Consumer Code.
Upon receipt, the Customer checks the condition of the package in the presence of the delivery person and notes precise reservations on the delivery note in case of damaged packaging. They inform the seller as soon as possible, with supporting photos. The risk of loss or damage is transferred to the Customer at the moment they physically take possession of the product (Article L216-4 of the Consumer Code).
Article 8 – Right of Withdrawal
The Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify their decision. The procedures, return costs borne by the Customer, and refund conditions are detailed on the Returns and Refunds page, which includes the standard withdrawal form.
Article 9 – Legal Guarantees
The seller is bound by the legal guarantee of conformity (Articles L217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code).
Legal guarantee of conformity. The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, they are only required to establish the existence of the lack of conformity and not the date of its appearance. The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience. If the goods are repaired under this guarantee, the consumer benefits from a six-month extension of the original guarantee. The consumer may obtain a reduction in the purchase price while keeping the goods or terminate the contract and receive a full refund upon return of the goods, notably if the seller refuses to repair or replace the goods, if the repair or replacement does not occur within thirty days, or if the defect is so serious that it justifies the price reduction or immediate termination of the contract. The consumer is then not required to request repair or replacement of the goods beforehand. The consumer is not entitled to terminate the sale if the lack of conformity is minor. Any period of immobilization of the goods for repair or replacement suspends the remaining guarantee until the delivery of the restored goods. The rights mentioned above result from the application of Articles L217-1 to L217-32 of the Consumer Code. A seller who willfully obstructs the implementation of the legal guarantee of conformity faces a civil fine of up to 300,000 euros, which can be increased to up to 10% of the average annual turnover (Article L241-5 of the Consumer Code).
Guarantee against hidden defects. The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept or a full refund upon return of the goods.
For any request under the guarantees, the Customer contacts the seller at contact@lamaisonorvane.com, indicating their order number and attaching photos of the defect.
Article 10 – Liability
The seller cannot be held responsible for non-performance of the contract due to the Customer's fault, an unforeseeable and insurmountable act of a third party, or force majeure. The Customer is invited to follow the usage and maintenance instructions on the product page and in the manual.
Article 11 – Personal Data
The Customer's personal data are processed in accordance with the Privacy Policy.
Article 12 – Intellectual Property
The texts, visuals, and graphic elements of the website are protected. Any reproduction without authorization is prohibited.
Article 13 – Complaints and Mediation
For any complaint, the Customer first contacts customer service: contact@lamaisonorvane.com or 06 11 76 81 77. In accordance with Articles L612-1 et seq. of the Consumer Code, the Customer may free of charge resort to a consumer mediator to resolve a dispute amicably, after having attempted to resolve it directly with the seller by a written complaint. Maison Orvane is currently joining a consumer mediation scheme; its details will be indicated here as soon as the membership is finalized.
Article 14 – Applicable Law
These GTC are subject to French law. The consumer Customer retains the benefit of the mandatory provisions of the law of their country of residence. In the absence of an amicable resolution, the dispute may be brought before the competent courts.
